FixZone User Agreement

Effective Date: November 18, 2025

Entity: Fixzone Inc., a Delaware corporation operating primarily in New York

This User Agreement (“Agreement”) is a legally binding contract between you (“User,” “you,” “your”) and FixZone Inc. (“Fixzone,” “we,” “our,” or “us”). By creating an account, accessing our website, or using the FixZone mobile application (collectively, “Services”), you agree to this Agreement. If you do not agree, you must not use FixZone.


1. Fixzone’s Role – Neutral Marketplace

FixZone is a neutral technology platform that connects:

  • Individuals seeking home-related services (“Clients”)
  • Independent contractors offering these services (“Providers”)

FixZone does not:

  • Provide home services
  • Employ Providers
  • Supervise or control Providers
  • Guarantee service quality

All services are performed exclusively by independent Providers.

2. User Eligibility

Users must:

  • Be at least 18 years old
  • Be able to enter legally binding agreements
  • Use Fixzone only for lawful purposes
  • Provide accurate information during registration

Fake accounts or misrepresentation may result in immediate removal.

3. Account Creation & Responsibilities

3.1 Account Accuracy

You agree to provide true, accurate, and complete information, keep your contact details updated, and maintain your login credentials confidential.

3.2 One User, One Account

Users may not create multiple accounts (without FixZone’s written approval), share accounts with others, or create accounts on behalf of others (except approved business entities).

3.3 Unauthorized Access

If you suspect your account has been compromised, you must notify us immediately at:

Users are responsible for all activity that occurs under their accounts.

4. User Conduct Requirements

Users must comply with:

  • This User Agreement
  • Fixzone’s Terms of Service
  • Acceptable Use Policy (AUP)
  • Provider Conduct Policy (if applicable)
  • Cancellation & Refund Policy

Failure to comply may result in suspension or termination.

5. Job Requests & Obligations for Clients

Clients agree to:

  • Provide accurate job details
  • Ensure safe access for Providers
  • Pay for all completed services
  • Use Fixzone’s in-app tools for communication
  • Not engage in off-platform transactions
  • Treat Providers respectfully

Clients may NOT:

  • Request illegal, unsafe, or unlicensed work
  • Provide false or misleading information
  • Cancel excessively without valid reasons
  • Harass, threaten, or pressure Providers
  • Stage or falsify job-related damage

6. Obligations for Providers

Providers must:

  • Maintain all required licenses and insurance
  • Arrive on time and prepared
  • Provide professional-quality services
  • Use safe tools and follow local codes
  • Communicate via the App whenever possible

Providers may NOT:

  • Request or accept direct payments outside FixZone
  • Perform unlicensed or unsafe work
  • Falsify documentation or job details
  • Abuse FixCoin rewards or promotions
  • Cancel excessively without cause
  • Harass or mistreat Clients

Providers remain fully responsible for their own work and conduct.

7. Payments

FixZone uses Stripe for secure payment processing. Users agree to provide valid payment methods, pay all fees and charges associated with bookings, and allow FixZone to pre-authorize, capture, or adjust charges as needed for completed services or adjustments. FixZone does not store full payment card numbers.

8. Pricing & Fees

Users agree that job pricing may vary based on service category, urgency, or scope; that in some categories Providers may set their own prices; that FixZone may charge platform or service fees to Clients and/or Providers; and that FixZone reserves the right to modify fees at any time with notice.

9. FixCoin Reward Program

FixCoin is a promotional credit internal to FixZone, non-refundable, non-withdrawable, and not transferable between users. It is subject to expiration (typically 6 months) and limited to 3% usage per transaction per side (Client & Provider).

Misuse of FixCoin, including fraud or abuse of promotions, may result in account suspension or termination. Users agree FixCoin has no cash value outside FixZone.

10. Location Data

By using FixZone, you consent to collection of approximate location (e.g., area, ZIP code), optional precise location if enabled on your device, and secure storage of service addresses. FixZone never publicly displays exact home addresses. See the Location Services Disclosure for additional details.

11. Reviews & Ratings

Users agree to:

  • Provide honest, factual reviews
  • Not offer or accept incentives for reviews
  • Not post defamatory, false, or misleading content

FixZone may remove or moderate reviews that violate policy, law, or basic fairness.

12. Disputes Between Users

FixZone may assist in dispute resolution between Clients and Providers but is not obligated to do so. Users agree that:

  • Fixzone’s dispute decisions are final for platform-related matters
  • Fixzone is not liable for the actions or omissions of Providers or Clients
  • Chargebacks may result in suspension or termination

13. Prohibited Activities

Users may NOT:

  • Circumvent the Fixzone platform
  • Engage in illegal or fraudulent activity
  • Harass, threaten, or harm others
  • Upload or distribute malicious code
  • Reverse-engineer the app or backend systems
  • Use bots, scrapers, or unauthorized automation
  • Create fake, duplicate, or spam accounts
  • Abuse promotions, discounts, or FixCoin rewards

Violations may lead to account restriction or permanent removal.

14. Termination of Account

FixZone may suspend or terminate accounts for:

  • Policy violations
  • Fraud or suspected fraud
  • Safety concerns
  • Repeated cancellations
  • FixCoin abuse
  • Excessive chargebacks or payment disputes
  • Unprofessional, abusive, or unsafe conduct

Users may also request account deletion in accordance with the Account & Data Deletion Policy. FixZone may retain certain records as required by law.

15. Intellectual Property

All rights in and to the FixZone platform, including logo and branding (including the LOFB system), app and website design, text, graphics, content, software, code, architecture, algorithms, and data structures, are owned exclusively by FixZone. Unauthorized use is strictly prohibited.

16. Limitation of Liability

To the maximum extent permitted by law, FixZone is not liable for actions or omissions of Providers or Clients, injuries, damages, or losses arising from services, delays, cancellations, no-shows, property damage, service quality outcomes, or app errors and downtime. Fixzone’s total liability for any claim is limited to the amount paid by the user through FixZone in the twelve (12) months preceding the event giving rise to the claim.

17. No Warranty

FixZone provides the platform “as-is” and “as available.” We do not warrant error-free operation, uninterrupted access, accuracy of listings or content, or fitness for a particular purpose.

18. Binding Arbitration & Class Action Waiver

Users agree that disputes with FixZone will be resolved by binding arbitration, on an individual basis (no class actions), without judge or jury, and under the Federal Arbitration Act (where applicable). This arbitration and class action waiver is a condition of using FixZone.

19. Governing Law

This Agreement is governed by Delaware law for corporate matters and New York law for operational matters. Arbitration typically occurs in New York County, New York, unless otherwise agreed.

20. Amendments

FixZone may update this Agreement at any time. Continued use of the platform after updates indicates acceptance of the revised Agreement.
