Terms of Service FixZone

1. Acceptance of Terms

By accessing, installing, or using the Fixzone mobile application (“App”), website (“Site”), or any related services (“Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use Fixzone. Fixzone Inc. (“Fixzone,” “we,” “our,” or “us”) reserves the right to update or modify these Terms at any time.

2. Nature of the Platform — Neutral Marketplace

Fixzone is a neutral marketplace that connects individuals seeking home-related services (“Clients”) with independent service professionals (“Providers”). Fixzone does not provide any services and Providers are independent contractors, not employees, agents, or representatives of Fixzone. Fixzone is not responsible for the quality, safety, timing, pricing, or outcome of services performed by Providers. This classification is essential and agreed to by all users.

3. Eligibility

You must be at least 18 years old, capable of forming a binding contract, and using Fixzone for lawful purposes. Providers must additionally meet Fixzone’s verification criteria.

4. Account Registration

Users must create an account and provide accurate information. Fixzone may verify submitted information, deny or suspend accounts, request additional documentation, or terminate accounts for fraud, misconduct, or policy violations.

5. Location Data & Privacy

Fixzone collects approximate location data to display service areas. Exact addresses are never shown to other users. Providers only receive a client's precise address after accepting a job. All location data is processed under our Privacy Policy.

6. Payments Through Stripe

Fixzone uses Stripe as its secure payment processor. By using Fixzone, you agree to comply with Stripe’s Terms of Service, Stripe Connect requirements, and applicable financial regulations. Fixzone does not store full credit card numbers.

7. Fees

Fixzone may charge various client and provider fees.

• Booking or service fees (Clients)
• Commission or membership fees (Providers)

Fixzone may modify fees with notice to users.

8. Provider Responsibilities

Providers must maintain licenses, deliver professional-quality work, provide honest information, and avoid off-platform transactions. Providers must comply with the full Provider Agreement.

9. Client Responsibilities

Clients must provide accurate job details, ensure safe access, pay for completed services, and avoid illegal or unsafe requests.

10. FixCoin Reward Program

FixCoin is a non-refundable, non-withdrawable internal credit with a 6-month expiration. Usage is limited to 3% per transaction per side. Misuse may result in termination. Full FixCoin Program Terms apply.

11. Marketplace Disclaimers

Fixzone does not guarantee work quality, employ Providers, supervise Providers, or assume liability for injuries, damages, delays, or disputes. Users agree to release Fixzone from claims arising between Clients and Providers.

12. Reviews

Users must not post false, defamatory, or incentivized reviews. Fixzone may remove reviews violating these rules.

13. Cancellations & Refunds

Detailed rules are found in the Cancellation & Refund Policy. Fixzone may issue or deny refunds and may apply cancellation fees.

14. Disputes Between Users

Fixzone may assist with disputes but is not obligated to. Decisions are final, and Fixzone is not liable for dispute outcomes.

15. Limitation of Liability

Fixzone’s liability is limited to amounts paid in the past 12 months. Fixzone is not liable for damages arising from Provider or Client actions.

16. No Warranty

Fixzone provides services “as-is” and does not guarantee error-free operation, continuous availability, or accuracy.

17. Binding Arbitration Agreement

All disputes between you and Fixzone must be resolved through binding arbitration. No class actions, no jury trial, and no group arbitration are permitted.

18. Class Action Waiver

You agree not to participate in class actions, class arbitrations, or representative actions. This waiver is a condition of using Fixzone.

19. Governing Law

These Terms are governed by the laws of Delaware and the operational laws of New York. Arbitration occurs in New York County unless otherwise agreed.

20. Termination

Fixzone may suspend or terminate accounts for violations, fraud, FixCoin abuse, unsafe behavior, or off-platform transactions. Termination does not entitle users to refunds.

21. Intellectual Property

All Fixzone trademarks, LOFB identity, logos, and platform content are owned by Fixzone. Unauthorized use is strictly prohibited.
